Index Harmony Distance Sales & Subscription Agreement

Last updated: 9 July 2026 · This is a courtesy translation. This Agreement is governed by Turkish law (Law No. 6502 and the Distance Contracts Regulation); in the event of any conflict, the Turkish version prevails and is the sole legally binding text.

This Distance Sales & Subscription Agreement (“Agreement”) is entered into, under Turkish Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation (“Regulation”), between the Service Provider identified below and the user (“Platform” or “Index Harmony”) who places an order/subscribes electronically via indexharmony.com and/or its associated applications. This Agreement forms an integral part of the Pre-Contract Information Form presented to the User before completing payment, and must be read together with that Form.

SECTION 1 – PARTIES

(Hereinafter the “Service Provider”, “Seller” or “Index Harmony”.)

1.2. Buyer / Subscriber (“User”)

Any individual or legal entity who creates an account, places an order, subscribes to a paid Plan, or purchases the Fix Pack product via the Index Harmony Platform.

SECTION 2 – DEFINITIONS

Platform / Service: Index Harmony's scanning/reporting service, which analyzes how crawlable, understandable and accessible websites are to AI-powered search engines and agents.
Scan/Report Service: the automated technical analysis performed for one or more websites/projects specified by the User, and the resulting digital report.
Fix Pack: a downloadable/licensable WordPress plugin product developed to remedy compliance issues identified by a scan.
Plan / Subscription: a paid membership package for a defined period (monthly/annual). As of the date of this Agreement, the Platform does not auto-renew (see Section 9).
Credit: a numeric usage right granted to the User under a given Plan and consumed by scan/analysis operations.
Pre-Contract Information Form: the information notice the User approves before payment, which forms an annex to this Agreement.

SECTION 3 – SUBJECT AND SCOPE OF THE AGREEMENT

This Agreement governs the sale, delivery/activation, payment terms and the parties' rights and obligations regarding the Scan-Report Service, the Fix Pack WordPress plugin and/or Plan-based subscription services ordered electronically by the User via the Index Harmony Platform. The Agreement is deemed formed electronically the moment the User confirms payment.

SECTION 4 – DESCRIPTION OF SERVICES AND PRODUCTS

4.1. Scan and Reporting Service

Index Harmony performs an automated technical scan of the website(s) specified by the User and produces an “AI readability/accessibility” score and a detailed improvement report. The Report is informational and advisory in nature; no specific outcome is guaranteed.

4.2. Fix Pack – WordPress Plugin

Fix Pack is a software product, downloadable and/or activated by license key, that helps remedy technical issues identified by a scan.

4.3. Subscription Plans and Credit/Project Limits

Each Plan contains usage limits such as a defined number of projects/sites, scan credits and report frequency.

SECTION 5 – PRICE, PAYMENT METHODS AND INVOICING

5.1. Payment by Credit Card

Credit-card payments are collected instantly via the Platform's contracted payment provider, PayTR.

5.2. Payment by Bank Transfer / EFT (Admin-Approved)

Bank-transfer/EFT payments are activated once manually approved by the Index Harmony team, typically within one (1) business day.

5.3. Invoice

An invoice/e-archive invoice is delivered electronically to the User's registered e-mail address.

SECTION 6 – ORDER / SUBSCRIPTION CONFIRMATION PROCESS

Once payment is completed, the order/subscription is deemed established, and access to the Service is provided via the User's account dashboard.

SECTION 7 – RIGHT OF WITHDRAWAL

7.1. General Period

The User has the right to withdraw within fourteen (14) days of the Agreement being formed; this statutory right is reserved in all cases, independent of the refund policy described in Section 8.

7.2. Cases Where the Right of Withdrawal Cannot Be Exercised

Where performance began, with the User's explicit consent, before the withdrawal period expired, and the Service has been fully performed;
For electronically, instantly-performed services or intangible goods (e.g. Fix Pack) — once the license is activated or the software downloaded;
For personalized report/analysis outputs.

7.3. Fix Pack – Special Case

Once the Fix Pack license has been delivered, the right of withdrawal cannot be exercised. Before delivery, the User may submit a withdrawal request within 14 days to info@indexharmony.com.

7.4. Withdrawal on Bank-Transfer Orders

For bank-transfer orders not yet admin-approved, the User may withdraw at any time before approval; any amount received is refunded within 5 business days.

SECTION 8 – REFUND AND CANCELLATION CONDITIONS

8.1. General Refund Policy

The Company does not, as a matter of policy, offer discretionary refunds (“no refund policy”). Cases where the statutory right of withdrawal still applies, or a technical fault, duplicate charge, or rejected bank transfer occurs, are excluded from this principle — a refund is always given in those cases.

8.2. Refund Process

Approved refunds are made within five (5) business days.

8.3. Partial Use / Credit Consumption

Within the 14-day withdrawal period, unused credit is refunded pro-rata; after that period, the general no-refund principle applies.

SECTION 9 – TERM AND TERMINATION OF THE SUBSCRIPTION (NO AUTO-RENEWAL)

9.1. No Automatic Renewal

The Platform does not auto-renew. A User who wishes to continue must manually place a new order from the account dashboard.

9.2. Ending Use Mid-Period

The User may stop using the Service at any time; no separate cancellation notice is required.

9.3. Purchasing a New Plan / Additional Credits

A new Plan/credit purchase is processed as a separate order; no proration against the current period is made.

SECTION 10 – INTELLECTUAL PROPERTY RIGHTS

All intellectual-property rights in the Platform, the Index Harmony brand, scanning algorithms and software code belong to the Service Provider or its licensors.

SECTION 11 – USER OBLIGATIONS

The User is responsible for the accuracy of their account/payment information and for ensuring they own or are authorized to scan the websites they submit.

SECTION 12 – LIMITATION OF THE SERVICE PROVIDER'S LIABILITY

Index Harmony does not guarantee any specific outcome; its liability is in all cases limited to the amount paid by the User for the relevant period.

SECTION 13 – PROTECTION OF PERSONAL DATA (KVKK)

Personal data is processed under KVKK and the separately published KVKK Notice; deletion requests may be sent to info@indexharmony.com.

SECTION 14 – FORCE MAJEURE

Natural disaster, cyberattack, infrastructure outages and similar events are considered force majeure.

SECTION 15 – TERMINATION OF THE AGREEMENT

Index Harmony reserves the right to suspend the Service or terminate this Agreement in the event of conduct contrary to applicable law.

SECTION 16 – DISPUTE RESOLUTION AND COMPETENT COURT

Disputes within the monetary limits set by the Ministry of Trade fall under the Consumer Arbitration Committees; disputes exceeding those limits fall under the Ankara Consumer Courts and enforcement offices.

SECTION 17 – EFFECTIVENESS AND ACCEPTANCE

The User is deemed to have accepted this Agreement upon confirming their order. The Agreement takes effect on the date payment is confirmed.
