Index Harmony – Pre-Contract Information Form

This is a courtesy translation; in the event of any conflict, the Turkish version prevails.

This Pre-Contract Information Form (“Form”) is prepared under Turkish Law No. 6502 on the Protection of Consumers (“Law”) and the Distance Contracts Regulation (“Regulation”), to inform the buyer (“Consumer”) before a distance contract is formed for Index Harmony services offered via indexharmony.com (the “Site”). By confirming an order, the Buyer declares that they have read and accepted this Form.

Section 1 – Subject and Scope

This Form covers the essential characteristics, sale price, payment method, and delivery/performance conditions of the Index Harmony products/services that are the subject of the distance contract formed electronically between the Seller and the Buyer, as well as information on the Buyer's right of withdrawal and the parties' rights and obligations.

Section 3 – Buyer (Consumer) Information

The name/legal name, billing address and e-mail entered on the Site at the time of order appear in the order summary and the order confirmation e-mailed to the Buyer. The Buyer is responsible for the accuracy of this information.

Section 4 – Essential Characteristics of the Services and Products

4.1 Website Scan and Reporting Service

Index Harmony automatically scans the website(s) specified by the Buyer to analyze how readable, crawlable and accessible they are to large-language-model-based AI search engines and agents, and produces a digital report (the “Report”) as a result. The Report does not constitute a guarantee of future search-engine/AI-agent behavior or traffic growth.

4.2 Sale of the WordPress Plugin (“Fix Pack”)

Fix Pack is a downloadable/installable WordPress plugin (digital content) offered to help remedy certain technical deficiencies identified in the Report. It is delivered electronically as a license key and/or download link; no physical shipment is involved.

4.3 Plan / Subscription and Credit System

Index Harmony services may be offered as periodic (monthly/annual) packages containing a defined number of project/site scans, credits and/or report entitlements. The Platform does not auto-renew — each Plan expires automatically at the end of its period, and the Buyer must place a new order to continue (see Section 9).

Section 5 – Price, Taxes and Payment Method

5.1 Pricing

The tax-inclusive sale price of the ordered service/product is clearly shown on the Site and in the order summary before the order is completed.

5.2 Payment Methods

  1. Online Payment by Credit/Debit Card – processed via PayTR with 3-D Secure verification; the order is processed automatically once payment is confirmed.
  2. Bank Transfer / EFT (Admin-Approved) – the Buyer sends a transfer/EFT to the details shown at checkout; the order is activated once payment has been manually verified and approved (“Admin Approval”).

5.3 Bank Transfer/EFT Approval Process

  • The Buyer must report the receipt/reference information via the Site or to info@indexharmony.com.
  • Payment is checked and approved or rejected within an average of one (1) business day.
  • Orders whose payment does not match, or does not arrive within a reasonable time, are cancelled; any amount received is refunded within 5 business days.
  • Once approved, performance/access begins immediately.

Section 6 – Delivery / Method and Time of Performance

Index Harmony services are performed electronically; no physical shipping/delivery is involved.

  • Scan/Report Service: the scan starts automatically once payment is confirmed; the Report is delivered to the Buyer's account and/or e-mail once complete.
  • Fix Pack: the download link/license key is made available in the Buyer's account and/or sent by e-mail once payment is confirmed.
  • Plan/Subscription: credits/project entitlements for the relevant Plan are assigned to the Buyer's account and made available once payment is confirmed.

Section 7 – Right of Withdrawal

7.1 General Withdrawal Period

The Buyer has the right to withdraw from the contract within fourteen (14) days of its formation, without giving any reason, subject to the exceptions in 7.2.

7.2 Cases Where the Right of Withdrawal Cannot Be Exercised

  • Instantly-performed electronic service/intangible good: the right of withdrawal cannot be exercised once the Report has been delivered or the Fix Pack license has been sent.
  • Early performance with Buyer's consent: if the Buyer has approved immediate performance and performance has actually begun, the right of withdrawal ends.
  • For partially-used Plan/credit balances, the right of withdrawal may only be assessed for the portion not yet used.

7.3 How to Exercise the Right of Withdrawal

Where applicable, the Buyer must submit this request in writing, within the withdrawal period, to info@indexharmony.com.

Section 8 – Refund Process and Conditions

  • General principle: the Seller does not, as a matter of policy, offer discretionary refunds (“no refund policy”).
  • Notwithstanding this, for portions where the right of withdrawal still applies and performance has not yet occurred, or in the event of a performance failure caused by the Seller, or a duplicate charge, the amount paid is refunded within five (5) business days at the latest.
  • For requests made within the 14-day withdrawal period involving partially-used credit/project entitlements, the refund amount is calculated pro-rata based on the unused portion.
  • For refunds of bank-transfer payments, the Buyer may be asked for a bank account/IBAN in their own name.

Section 9 – End of Subscription (No Auto-Renewal)

  • The Platform does not auto-renew. A Plan expires automatically at the end of its selected period.
  • A Buyer wishing to continue must manually place a new order from the account dashboard.
  • The general principle and time limits in Section 8 apply to any unused credit/time balance within the current period.

Section 10 – Intellectual Property and License

Fix Pack and all software, report templates, algorithms, trademarks and content within Index Harmony belong to the Seller or its licensors. The Buyer is granted only a personal/commercial, non-exclusive, non-transferable right of use.

Section 11 – Service Limitations and Disclaimer

The Report and suggested fixes produced by Index Harmony are recommendations based on technical data captured at the time of the scan. The Seller does not guarantee the future behavior of third-party AI systems or that any particular commercial outcome will be achieved.

Section 12 – Protection of Personal Data (KVKK)

The Buyer's personal data is processed under Turkish Law No. 6698 (KVKK) for the purposes of forming and performing the contract, invoicing, and complying with legal obligations. The Buyer may exercise their statutory rights, including the right to request erasure or destruction of their data, by writing to info@indexharmony.com. Section 13 – Complaints and Dispute Resolution

Complaints relating to this Form may be raised with the Consumer Arbitration Committee, within the monetary limits announced annually by the Ministry of Trade, or with the Consumer Courts for disputes exceeding those limits.

Section 14 – Force Majeure

Natural disaster, pandemic, cyberattack, infrastructure/data-center outage, war, strikes, changes in legislation and similar unforeseeable events beyond a party's control (“Force Majeure”) do not constitute a default for as long as the affected party is unable, or delayed, in performing its obligations.

Section 15 – Language, Effectiveness and Acceptance

This Form is drafted in Turkish; this English version is provided as a courtesy translation. By confirming an order, the Buyer electronically confirms having read, understood and accepted this Form. The competent courts and enforcement offices are the general-jurisdiction courts and enforcement offices of the Seller's domicile (Ankara, Türkiye).
